Professional body and rules

Czech Bar Association (Česká advokátní komora), Národní 16, 110 00 Prague 1, Czech Republic (www.cak.cz). The legal profession is governed by Czech Act No. 85/1996 Coll., on the Legal Profession, and the professional rules of the Czech Bar Association, available on its website.

Professional liability insurance

The attorney is insured against liability for damage caused to a client in connection with practising law (Section 24a of the Czech Legal Profession Act).

Out-of-court resolution of consumer disputes

The body for out-of-court resolution of consumer disputes arising from legal services agreements is the Czech Bar Association, authorised by the Ministry of Industry and Trade. More information is available at www.cak.cz.

Terminating a legal services agreement

The client may terminate the legal services agreement at any time, without giving reasons. A notice period may be agreed but may not exceed three months. Unless agreed otherwise, the attorney must, for 15 days after the agreement ends, take any urgent steps needed to prevent harm to the client; this does not apply if the client states that they do not require it (Section 20 of the Czech Legal Profession Act).

Fees

Fees are governed by the agreement with the client. Where no fee is agreed, the provisions of Czech Decree No. 177/1996 Coll. (the attorneys’ tariff) on non-contractual fees apply (Section 1 of the tariff).

Client identification

The attorney is an obliged entity under Czech Act No. 253/2008 Coll., on Certain Measures against Money Laundering and Terrorist Financing. Before providing certain services, the attorney must therefore identify the client and keep identification data and copies of documents for 10 years (Section 16 of that Act). Details are set out in the Privacy policy.
